वैश़्विकरण के इस आधुनिक दौर में सामाजिक-आर्थिक न्याय

देश की आजदी के 64 वर्षों बाद भी सामाजिक-आर्थिक रुप से वंचित तबका अगर न्याय पाने की आस लगाये हुए है, तो भारत जैसे लोकतांत्रिक देश में इससे बडी विड्म्बना और क्या हो सकती है? संविधान निर्माण के समय संविधान निर्मताओं ने बडी-बडी बातें कही और उस दौर मे ढेर सारे कनूनों को सम्मिलित व पारित करवया, लेकिन यह भावना संविधान एवं कानून के किताबों में सिमट कर रह गयी है, और समाज में ये लोग न्याय की उम्मीद में अभी भी इधर-उधर भटक रहें है। यह भटकाव उसकी माली व दयनीय स्थिति को भी दर्शाता है, जिनको पेट भरने के लिये सरकरी अनाजों कि राह देखनी पडती हो, भला उसके लिये आज की इस महँगी न्याय व्यवस्था में न्याय की उम्मीद करना भी बेमानी ही होगा।

वैश़्विकरण के इस आधुनिक दौर में जहाँ ग्लोबल गाँव की संकल्पना सामने आयी है। वहीं देश में सामाजिक-आर्थिक रुप से पिछड़ें लोग अभी भी मुख्याधारा की राजनीति में अपने को छला हुआ महसूस कर रहें है, क्योंकि आजादी के इतने वर्षों के बाद भी वह समाज में बराबरी का अवसर पाने के लिये संघर्षरत है, वो इसलिए कि समाज के कुछ साधन सम्पन्न और ताकतवर लोग उन्हे कानून के मकडजाल मे उलझाये हुए है। यही मकडजाल उसकी नीयती ना बन जाये, इसलिए हम साथिंयों ने ऐसे वंचित तबके की आस (न्याय) को जमीनी स्तर पर क्रियान्वयन करने का निर्णय लिया है, ताकि उम्मीद की मशाल बुझने न पाये। समाज में सभी की हैसियत बराबरी की होनी चहिये, न कि भेदभावपूर्ण, चाहे बात न्याय पाने कि अवसर की ही क्यों न हों। समाजिक बराबरी से वचिंत तबका देश में आत्म सम्मान और गौरवपूर्ण जीवन जी सकेगा और इसके साथ वह देश की प्रगति का हिस्सा भी बनेगा,जिससे सामाजिक सौहार्द का माहौल बनेगा, जो सामाजिक गतिशिलता के लिये आवश्यक ही नहीं बल्की जरुरी भी है,लेकिन कुछ मुठठी भर लोग समाज मे ऐसा नहीं होने देना चाहतें हैं, ऐसी ही शक्तियों को हम साथी मिलकर न्यायिक तरीके से नेस्तेनाबूत करेंगे ।

देश की आबादी की बहुसंख्यक जनता गरीबी रेखा के नीचे जीवन यापन कर रही है। अर्जुनसेन समिति के अनुसार देश की 80% जनता 20रु प्रतिदिन खर्च करके जीवन क निर्वहन कर रही है, तो प्रश्न उठना लाजमी है,कि वह अपने हीतों की रक्षा के लिए न्यायलय का दरवाजा कैसे खटखटा सकती है। अतः इन जायज सवालों को कुरेदने पर, जमीनी हकीकत का ज्ञान स्वाभाविक रुप से हो गया हो जायेगा।

 एक बात और, 19वीं शताब्दी में यूरोप के कुछ देशों में नारी मुक्ति के लिए तिव्र आंन्दोलन प्रारम्भ हुए, जिनके मुख्य बिन्दु थे, नारी की स्वतंत्रता, समानता, न्याय की सामान अवधारणा, व राजनीत मे बराबर की भागीदारी। और इस दिशा मे काफ़ी प्रगति भी हुई, लेकिन यह विडम्बना ही है कि भारतीय समाज में इस तरह का कोई विशेष आंदोलन नहीं हुआ अगर हुआ भी तो उसका प्रभाव न के बराबर रहा। और नारी मुक्ति के तमाम मौजूदा सवाल अभी भी कायम है,अगर किसी समाज मे नारी की दशा उच्च-स्तर की होती है, अर्थात अगर उन्हें भी अगर बराबरी का अधिकार मिला हो तो वह समाज विकसित कहा जाता है, लेकिन भारतीय पुरुष प्रधान समाज अपनी पकड अभी ढीली नहीं होने देना चहता है, क्योंकि उसे भय है, कि अगर स्त्री मुक्त हुई तो उनकी राज्य सत्ता की बागडोर खतरे मे पड जायेगी। इसीलिए वह शोषण के नये-नये यंत्र विकसित करने लगा है।

भारतीय समाज में नारी को अपनी सामाजिक-आर्थिक, और राजनैतिक भूमिका तय करने के लिए स्वंय को आगे लाना ही होगा, तभी सार्थक दिशा मे पहल हो पायेगी। इसका जिता जगता उदहरण- महिला आरक्षण विधेयक है,जो महिलाओं के दबाव तो लया गया पर संसद मे पारित होने के लिए अभी भी दूर की राह साबित हो रहा है। सवाल यह है, कि नारी मुक्ति के लिये प्रयास किसे करना होगा ! जबाब मिलता है- नारी को स्वयं लड़ कर करना होगा, न कि किसी के रहमो-करम पर लडाई लडनी होगी।

साथियों, हमारे लाँ फ़र्म की स्थापना को हम नारी मुक्ति के लिए एक कदम के रुप में भी देख रहे हैं, क्योंकि वंचित तबको की अवधारणा में स्त्री भी सम्मिलित है। जिसको समाज में बराबरी का अधिकार आज भी प्राप्त नही है। आज भी साथ इनके हमारे तथाकथित सभ्य समाज मे कई जगहों पर उत्पीड़न  का शिकार होना पडता है। चाहे वो भारी-भरकम्प दहेज देने के बाद की उत्पीड़न हो या किन्हीं अन्य कारणों से, न जाने कितने तरीकों से आज हर एक दुसरे-तीसरे घर मे ऐसी घटनाऐं होता ही है। इसको रोकने के लिए कई कानून भी बनाये गये है, जैसे-cr.p.c की धारा 125 या घरेलु हिंसा उत्पीड़न निवारण एंव रोकथाम अधिनियम को ही ले ले। परन्तु इसके बाद भी अपराध कम होने की जगह बढ़ ही रहा है, इसका एक जो सबसे बडा कारण सामने आता है तो वह है आम स्त्रियों को कानून की समझ न होना। हम साथिंयो ने अपने फ़र्म के माध्यम से ही महिलाओं मे जागरुकता लाने का अभियान चलाया है। जिससे इस तरह के आपराध होने पर वो घर मे ही घूटती ना रहें, वो कानून के माध्यम से अपने अधिकारों के लिए लडे। क्योंकि इतिहास गवाह है की लडकर ही अधिकारों को हासिल किया जा सकता है मुफ़्त मे यहाँ कुछ भी नहीं मिलता। तभी हम यहाँ सोचते है कि आधी आबादी भी अपनी भागीदारी से फ़र्म को मजबूती प्रदान करेगी, इसके माध्यम से अपनी आवाज को बुलदी के आसमान तक पहुचाऐगी। ऐसी हमे आशा और विश्वास है।

साथियों, फ़र्म की पुर्णत: स्थापना जनवरी 2012 तक की जयेगी, जिसके केन्द्र देश के विभिन्न शहरों जैसे- दिल्ली, पटना, इलहाबाद,और लखनऊ में प्राथमिक चरण में ही की जायेगी, तथा इसके क्षेत्रीय कार्यालय भी आवश्यता अनुसार देश विभिन्न शहरों मे स्थापित किये जायेगें। जिसके माध्याम से हम सभी साथी मिलकर पीडीत और वंचित तबकों के न्याय के लिये कानूनी लडाई लडेंगे, तथा मुफ़्त कानूनी सहायता एंव सलाह उपलब्ध करेंगें। यहाँ हम देश के तमाम जनवादी ताकतों से अपील भी करेंगें की वे हामारे इस प्रयास को सफ़ल बनाने मे अपनी हर तरह से भागीदारी सुनिश्चित करें, जिससे की हमारा ये प्रयास एक विशाल रुप मे जमीनी स्तर पर कार्यान्वित हो सके।

माँ ! यूं न दुत्कारों मुझे,

गर्भ मे पलते-पलते,

मांग रही हूँ आँचल में एक कोना,

मेरी आँखों को खुल जाने दो।

     मैं उठाऊँगी बोझ तुम्हारा,

      कैसे होगा पूर्ण संसार,

माँ के हाथों से तरशी गुडिया,

तोड न पाये कोई बहशी दरिन्दा,

न बिके बाजरों में अब कोई ‘नेहा’

किंचित न सुनाई पडे ऐसे बिलाप,

जिसके बिखरें हों बस्तों क ख्वाब,

बुझी हों एक अदद खुशी प्यास,

हाथों से ये लिखें कल्पना की उडान,

आँखों में इनके पले रंगीन किरण के ख्वाब,

गर्भ की दीवारों से शिशकियां बंद हों,

इनको मिले सम्मानित शबनमी ख्वाबों क महल,

ये लड्कियां बनें किसी के आंगन की किल्कारियां,

दफ़्न हो इनके खिलाफ़ चलने वाली रुढियां,

मिले इनको माँ ,बहन,पत्नी से उपर उठने क अवसर,

बढकर के आगे करें विश्व के भाल पर सशक्त हस्ताझर।

व्याथित अबला ( नारी )

हाँ! जी पहचाना आपने मुझे ! मैं वही भारतीय नारी हूँ, जिसे सभ्यता के शुरुआत से ही अबला के  पर्याय के रुप मे दर्शाया गया है। सभ्यता के साथ-साथ स्त्री ने अपने को कई रुपों मे व्यथित पाया, चाहे वो वासना तृप्ति के साधन के रुप मे,या बच्चों के जन्मदात्री के रुप मे

और तो और, पूरुषों के दासी के रुप ही तो स्थापित किया गया है हमें। 

मैं तब से आज तक बदलते दौर में उस शिल के समान हूँ, जिस पर राम के पैरों की ठोकर से चेतना आयी और उस ठोकर के इन्तजार में इस सुशुप्त समाज में अपनें अनुकूल बयार कि खोज में नि:शब्द मौन   हूँ।

स्वतन्त्रता के पुनर्जागरण काल से ही कई महापुरुषों ने हमारी पीडा को शब्द दिये जिससें सती प्रथा का अन्त तथा नारी शिक्षा पर बल मिला। परन्तु स्वतंत्रता के बाद जब भारतीय संबिधान बना तो हमारे कानों मे एक ठंडी हवा की आश सी आई, और आज 21वी सदी में प्रवेश के उपरान्त भी हमारी प्रगति एक अनिश्चितकालीन   प्रश्न वाचक शब्द पर टिकी है?

आज मैं अपनी व्यथा आपसे बताती हूँ- जब मैं गर्भ में रहती हूँ तो मेरा जन्म अधर में टिका रहता है कहीं मैं बडी होकर पिता और समाज के ऊपर एक बोझ न बन जाऊ, इसीलिए तो शायद हमें जन्म से पहलें ही मार दिया जाता है। मैंने गर्भ में माँ से कुछ यूँ मिन्नतें कीं जो स्वयं मजबूर थीं-

मेरी करुण पुकार

माँ ! यूं न दुत्कारों मुझे,

इस करुण क्रुंदन के उपरान्त मेरा जीवन यदि दया पर बच भी जायेगा तो मुझे दोयम दर्जा ही मिल पायेगा। यहा से मेरी व्याथा और बढ़ जाती है। बचपन की दहलीज पर आते ही मुझे निठारी का आँगन या उसके बंगला नंबर डी-5 कि चित्कार सुनाई पड़ती है जहॉ मुझ जैसे जाने कितनो को वहशी दरिन्दों ने वासना का समान समझ कर बलात्कार करके नालों मे फ़ेंक दिया जहाँ उनका परिवार उनके शव और न्याय की तलाश में आज भी भटक रहा है।

यदि बचपन में परिवार का सहयोग मिला तो मैं शिक्षित हो जाऊगी पर फ़र्क क्या पड़ता है,मुझ पर अब भी बन्दिशें होगीं। बंदिशे समाज के ठेकेदारों का,जिन्हें हमारे बदलते लिबास में नग्नता नजर आती हैं, या हमारे काम मे अशलीलता । आवाज अगर उठाये तो जुल्म से दबा दी जयेंगीं। यहाँ तक मैं 'पर' इच्छा पर आश्रित हूँ यदि वैवाहिक जीवन मे मेरा हस्तक्षेप मेरे पसंद के जिवन साथी को चुनने क होता है, तो पारिवारिक दबाव में उस इच्छा को दबा दिया जाता है या फिर आगे तो खाप पचांयत जैसी संस्थायें है ही ।

उम्र के आखिरी पडाव में नरी पूर्ण रुप से भोग ली गई है दबा ली गई है, पर अभी उसपर एक नया दर्द आना बाकी है अपनी संतानों के द्वारा दास बनकर वो अनन्त की ओर निहारिती हुई अपने जन्म को कोसती अपनी मरने की दुआ मगंती है।

ये तो समाज,परिवार के माध्याम से दी गई वेदना थी अब उन सबसे बढ़कर हमारे संसद द्वारा दी गई पीड़ा, महिला अधिकारों की नुमाइन्दगी का दम्भ भरने वाले चुने हुये प्रतिनिधि आजादी के 64 वर्षों के उपरांत महिला बिल को पास कराने मे अपनी असमर्थता जताते है परन्तु सांसदों के मानदेय सम्बन्धित बिल 24 घन्टों मे पारित हो जाता है। 2006 मे आया घरेलू हिंसा अधिनियम कानून की किताबों की शोभा भर बढा रहा है।

अन्त मे क्या कहूं इस समाज से जो हमारी इस दशा पर मौन है वे अगर हमारी प्रगति के लिए थोडा भी सहयोग करे तो निश्चित ही हम इस विश्व के धरातल पर सशक्त हस्ताक्षर करेंगें।

 "पीड़ा" 

समग्र विकास राष्ट्र का,

क्या हर व्यक्ति का विकास है ?

एक पुष्प का खिल जाना

क्या सम्पूर्ण वृक्ष विकास है?

घाट-घाट घूम के आये

न समझे अपने अधिकारों से 

लौट लौट खाट पर रोये

न मिले उपचारों से,

घुमड़-घुमड़ कर कितने बादल 

आये और चले गए,

जो बची थी आँखों में नमी,

उनके आश्वासन से सूख  गयी,

क्या खाते है क्या पीते है

कैसे जाने अधिकारों को 

दो जून की रोटी महंगी,

उनके कोरे कागज में,

कौन सुनता है आज हमारी 

बंद सरकारी पन्नो में 

जब भी "हक़" की मांग की  

मिली 'गोलियां' उपचारों में ,

कैसे लड़े हम इस कुटील कुटिस्ट विकारों से

कुंद पड़ी भूखी-नंगी इन तलवारों से,

तुम भी आओ हम भी आयें 

मिलकर एक चेतना लायें

दूर हो विधिक अधिकारों का अज्ञान

भारत के हर कोने से |

ये सिर्फ कविता ही नहीं है बल्कि 
आज की हमारी न्याय प्रक्रिया पर 
एक चोट भी है, क्या न्याय की 
यही वर्तमान प्रक्रिया बहुत हद तक 
दोषी नहीं हमारे समाज में असंतोष को
फ़ैलाने में...??..
इसी न्याय प्रणाली में 
सुधार के लिए हमारा छोटा सा प्रयास है

दण्ड की उत्पत्ति,दण्ड के सिद्धान्त

दंड-
राजनीतिशास्त्र के चार उपायों -- साम, दाम, दंड और भेद में एक उपाय; राजा, राज्य और छत्र की शक्ति और संप्रभुता का द्योतक और किसी अपराधी को उसके अपराध के निमित्त दिया गया हुआ दंड। संक्षेप में यह कहा जा सकता है कि दंड या तो धर्म, जाति और संप्रदायगत संस्कारों का द्योतक है अथवा वैयक्तिक और सामाजिक रक्षा के उपायों का प्रतीक।

दण्ड की उत्पत्ति

दंड की उत्पत्ति राज्यसंस्था की उत्पत्ति के साथ हुई। मनुस्मृति और महाभारत में यह कहा गया है कि मानव जाति की प्रारंभिक स्थिति अत्यंत पवित्र स्वभाव, दोषरहित कर्म, सत्वप्रकृति और ऋतु की थी, जब न तो किसी राजा की स्थिति थी, न राज्य था, न दंड था, न दंडी था और सभी लोग धर्म के द्वारा ही एक दूसरे की रक्षा करते थे। किंतु कालांतर में तामस्गुणों का प्राबल्य बढ़ने लगा, मनुष्य समाज अपनी आदिम सत्व प्रकृति से च्युत हो गया और मात्स्य न्याय छा गया। बलवान् कमजोरों को खाने लगे। ऐसी स्थिति में राज्य और राजा की उत्पत्ति हुई और सबको सही रास्तों पर रखने के लिये दंड का विधान हुआ। दंड राज्य शक्ति का प्रतीक हुआ जो सारी प्रजाओं का शासक, रक्षक तथा सभी के सोते हुए जागनेवाला था। अत: दंड को ही धर्म स्वीकार किया गया। इससे स्पष्ट प्रतीत होता है कि धर्म का साधक केवल दंड ही माना गया। वह धर्म जिसमें अर्थ और काम भी समाहित है अर्थात् दंड त्रिवर्ग का साधक स्वीकृत हुआ। आदर्श से स्खलंन को दूर करने के लिये दंड की आवश्यकता हुई।
राज्य की शक्ति के रूप में दंड न्यायिक क्षेत्र में प्रसारित होने लगा। उसका उद्देश्य था समाज और धर्म की मान्यताओं और यथास्थिति की रक्षा करना। वह यथास्थिति धर्म के नाम से अभिहित थी और धर्म के भी वर्ण, जाति, आश्रम, देश, काल, समूह, वर्ग, परिवार और व्यवसाय आदि भेदों पर आधारित और भिन्न भिन्न रूपों में मान्य अनेक प्रकार थे, जिनका ज्ञान धर्मासनस्थ दंडकर्त्ता के लिये अत्यावश्यक होता था। दंड का प्रयोग करनेवाला राजा भी यदि धर्म का उल्लंघन करे तो दंड का भागी होता था। धर्म अर्थात् विधि से परे कोई न था धर्म राजाओं का भी राजा था। राज्य का प्रधान राजा अथवा अन्य कोई शक्ति, यथा गणतंत्र का मुखिया न्यायिकय संगठन का प्रधान अवश्य था, किंतु विधि का प्रधान वह कभी नहीं हो सका और विधि के उल्लंघन करने पर दंड उसपर भी सवार हो जाता था। भारत में विधि और दंड की यह संप्रभुता ब्राह्मणकाल से लेकर मनुस्मृति और महाभारत के युग के बीच विकसित हुई दिखाई देती है।

दण्ड के सिद्धान्त

आधुनिक विधिशास्त्री दंड के चार सिद्धांत मानते हैं --
 प्रतीकारात्मक (Deterrent)
 निषेघात्मक (Retributive)
 अवरोधक (Preventive) और
 सुधारात्मक (Reformative)

सभी देशों में समाज की अत्यंत प्रारंभिक अवस्था प्रतीकारात्मक दंड की थी, जिसमें आँख के बदले आँख और दाँत के बदले दाँत (फोड़ देने और उखाड़ देने) का सिद्धांत चलता था। वैदिक साहित्य की "जीवगृभ" जैसी संज्ञाएँ इस बात की द्योतक हें कि भारतीय इतिहास के अत्यंत प्रारंभिक काल का न्याय कठोर और प्रतीकारात्मक ही था। इस सिद्धान्त की मान्यता है कि एक अपराधी को कठोर दण्ड देने से दूसरे लोग अपराध करने से डरते हैं।

निषेधात्मक सिद्धान्त की मान्यता है कि अपराधी को दण्ड देने से जिसके प्रति अपराध हुआ है उसे उसका 'बदला' मिल जाता है। यह सभी सिद्धान्तों में सबसे बुरा सिद्धान्त है क्योंकि इसमें समाज का कल्याण या समाज की सुरक्षा की भावना नहीं है।

तीसरी अवस्था में दंड का स्वरूप प्रतीकारात्मक के बदले अवरोधक हो गया। इसका कारण था दोषी मनुष्य के प्रति दोष किए गए हुए मनुष्य का निपट लेने के बजाय दंड धारण करनेवाले राज्य का बीच में आ जाना। व्यक्तिगत बदले की भावना को समाप्त कर राजकीय दंड की महिमा को स्थापित करना राज्य का उद्देश्य और उसकी बढ़ती हुई शक्ति का द्योतक हो गया। दीवानी के मामलों में अर्थदंड आदि द्वारा दोष किए गए हुए व्यक्ति को कुछ बदला दिलाना यद्यपि वैध माना गया, फौजदारी के मामलों में बदला लेना अब असंभव था। किंतु कठोर-कभी कभी तो अत्यंत क्रूर और असभ्य दंडों का दिया जाना प्राय: नियम सा था। यदि हम उपनिषदों के दैवदंडों, बौद्धग्रंथों में वर्णित दंडों, अर्थशास्त्र के द्वारा हाथ पाँव काट लिए जाने की अनुशंसाओं तथा मेगेस्थनीज द्वारा की जानेवाली उसकी संपुष्टियों को देखें अथवा पूर्व और पश्चिम दोनों ही ओर प्रचलित मध्यकालीन और कुछ हद तक आधुनिक काल के प्रारंभ तक के दंडों का विवेचन करें तो यह कहना होगा कि वे अत्यंत ही क्रूर और आधुनिक दृष्टि से बर्बर थे। उनका उद्देशय था औरों में अपराध करने के प्रति भय उत्पन्न करना। इनमें अंग-भंग, जीवित जला दिया जाना, मृत्युदंड, आजीवन कारावास और असह्य यातनाओं से भरे हुए दंड होते हैं। निरोधक दंडों में अपराध के कारण अथवा उसके भविष्य के कर्ता को ही उससे रोक देने का उपाय किया जाता है, जो उसकी व्यक्तिगत स्वतंत्रता छीनकर संपन्न होता है। भारतवर्ष का निरोधक जेल विधान (Preventive Detention Act) इसी श्रेणी में है।

चौथा और सर्वोत्तम दंड का प्रकार है सुधारात्मक।
सभ्यता के विकास के क्रम में भी यद्यपि सभी देशों में संभावित दोषियों के प्रति दोषों के गंभीर परिणाम और दंडयातनाओं का भय उपस्थित करने के लिय कठोर अवरोधक दंड दिए जाते रहे हैं, पर कभी-कभी सुधारात्मक प्रवृत्तियाँ भी उठती रही हैं। प्राचीन रोम में दोषी की स्वतंत्रता का हरण (जेल में डाल देना) मात्र ही सबसे बड़ा दंड माना गया और उसके बाद कोई यातना आवश्यक नहीं समझी गई (ad continendos non ad puriendos)।
भारत में कौटिल्य ने काराग्रस्तों को प्रायश्चित्त कराने और अपने पापों का बोध कराने की व्यवस्था के द्वारा उन्हें विशुद्ध कराने का उल्लेख किया है। अशोक ने भी अपने चतुर्थ स्तंभलेख में व्यवहारसमता और दंडसमता के साथ शुद्धचरित्र, धर्मरत और सद्व्यवहारी दोषियों के दंडों को कम करने का आदेश दिया है। ये बातें दंड विधान की सुधारात्मक प्रवृत्ति की द्योतक हैं। स्मृतियों में धिग्दंड अथवा वाग्दंड की चर्चाएँ आती हैं, जो सर्वदा कायदंड और वधदंड से पहले आता था। उसका तात्पर्य यह था कि सामाजिक निंदा मात्र से यदि काम चल जाय तो कठोर यातनाओं की आवश्यकताएँ ही क्या ? एक नियम तो सर्वमान्य था और वह यह कि दंड "यथाहै" हो और वह आप्तदोष होने पर ही दिया जाना चाहिए।
20वीं शती में दंडविधान को सुधारात्मक स्वरूप देने के प्रयत्न हो रहे हैं। 1872 ई में लंदन में एक अंतरराष्ट्रीय जेल सुधार और दंडविधान के किसी अंतरराष्ट्रीय स्वरूप को निश्चित करने के लिये सभा हुई। बाद में तत्संबंधी सामूहिक संघटन भी स्थापित हुए पर उसके सदस्य अधिकांशत: यूरोपीय देश ही रहे। धीरे धीरे कठोर दंडों के स्थान पर काराग्रस्त दोषी के नैतिक जीवन का पुनरुज्जीवन लक्ष्य माना जाने लगा। उसमें भय की अपेक्षा आशा अधिक रखी जाने लगी है। दंड के सुधारात्मक सिद्धांत में उसका विधान दोषी की अवस्था, सामाजिक वातावरण और स्थितिविशेष के आधार पर किया जाता है। दोषों के लिये समाज और वातावरण को भी उत्तरदायी माना जाता है। अत: दोषी को सुधारने के लिये मनोवैज्ञानिक उपायों का प्रयोग, उसका वैयक्तिक स्तर पर विचार, दोषी बालकों के लिय सुधारभवनों की व्यवस्था, औद्योगिक शिक्षा, साधारण शिक्षा, नैतिक और धार्मिक व्याख्यान और अन्य सुनियोजित व्यवस्थाएँ की जाती हैं। भारतवर्ष में भी कुछ अन्य देशों की तरह काराग्रस्तों को बँधनेवाले बाँधों, सड़कों अथवा अन्य निर्माणों में नौकरी और मजदूरी कराने अथवा औद्योगिक शिक्षाओं के द्वारा समाजोपयोगी और परिवारसेवी बनाने के प्रयत्न प्रारंभ हैं। असंभव नहीं कि कुछ सदियों में व्यक्तिगत स्वतंत्रता का अपहरण मात्र सबसे बड़ा दंड माना जाय और मानव स्वभाव इतना उदात्त और पवित्र हो जाये कि प्राणाहरण और आजीवन कठोर कारावास जैसे दंडों की आवश्यकता ही न रहे।
